Welcome to ProTerapia. These Terms of Use ("Terms") govern your access to and use of the ProTerapia platform, available at proterapia.com.br, operated by ProTerapia ("we", "our", or "Company").

By creating an account or using our services, you agree to these Terms in full. If you do not agree, do not use the platform.

1. Acceptance of Terms

By accessing or using the ProTerapia platform, you represent that:

• You are at least 18 years of age;
• You have the legal capacity to enter into this agreement;
• You have read, understood, and accept these Terms and our Privacy Policy;
• You will use the platform in compliance with applicable Brazilian law.

2. Service Description

ProTerapia is a SaaS (Software as a Service) clinic management platform designed for integrative therapists. Our services include:

• Schedule management and session booking;
• Patient registration and management;
• Electronic health records and session notes;
• Financial management and payment tracking;
• Multi-practitioner clinic management;
• Reports and performance analytics.

We reserve the right to modify, suspend, or discontinue platform features at any time, with reasonable prior notice.

3. User Accounts

To use the platform, you must create an account with truthful and up-to-date information. You are responsible for:

• Maintaining the confidentiality of your access credentials;
• All activities performed under your account;
• Notifying us immediately of any unauthorized use;
• Keeping your registration information current.

We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.

4. Subscriptions and Payments

ProTerapia offers subscription plans with different features and limits. By subscribing to a plan:

• Payments are processed by Stripe, our payment processor;
• Charges are recurring according to the chosen plan cycle (monthly or annual);
• Prices may be changed with 30 days' prior notice;
• You are responsible for maintaining a valid payment method;
• Applicable taxes will be added according to current legislation.

In case of payment failure, we may restrict platform access until the situation is resolved.

5. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Access to plan features will be maintained until the end of the current paid period;
• No prorated refunds will be issued for unused periods;
• Your data will be retained for 30 days after cancellation, as described in our Privacy Policy;
• After 30 days, data may be permanently deleted.

6. Intellectual Property

All intellectual property rights in the ProTerapia platform, including but not limited to software, design, logos, text, graphics, and features, belong exclusively to ProTerapia.

• You receive a limited, non-exclusive, non-transferable license to use the platform under these Terms;
• You may not copy, modify, distribute, sell, or create derivative works from the platform;
• You may not reverse engineer, decompile, or disassemble any part of the software;
• Data you enter into the platform remains your property.

7. Acceptable Use

When using the platform, you agree not to:

• Use the service for illegal or unauthorized purposes;
• Transmit viruses, malware, or malicious code;
• Attempt to access restricted areas of the platform or other users' data;
• Overload the infrastructure with excessive requests;
• Use the platform to store content that infringes third-party rights;
• Resell or sublicense platform access without prior authorization.

8. Limitation of Liability

To the maximum extent permitted by Brazilian law:

• The platform is provided "as is" and "as available";
• We do not guarantee the service will be uninterrupted, error-free, or completely secure;
• We are not liable for indirect, incidental, special, or consequential losses or damages;
• Our total liability is limited to the amount paid by you in the preceding 12 months;
• We are not responsible for clinical decisions made based on platform information.

This limitation does not apply to damages caused by willful misconduct or gross negligence by ProTerapia.

9. Therapist Responsibility

As a therapist using ProTerapia, you acknowledge that:

• You are the data controller for your patients' data under the LGPD;
• You must obtain appropriate consent from your patients for use of the platform;
• You must comply with the ethical and regulatory standards of your profession;
• ProTerapia does not substitute professional judgment;
• You are responsible for the accuracy of information entered into the platform.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. For the resolution of any dispute arising from these Terms, the parties agree to:

• First, attempt to resolve amicably through direct negotiation;
• If unsuccessful, submit the dispute to mediation;
• If the impasse persists, the courts of São Paulo, State of São Paulo, Brazil, shall have exclusive jurisdiction, waiving any other, however privileged.

11. Changes to Terms

We may update these Terms periodically. When we make significant changes:

• We will notify you by email or platform notice at least 30 days in advance;
• The "last updated" date will be revised;
• Continued use of the platform after the effective date of changes constitutes acceptance of the new Terms;
• If you disagree with the changes, you must cancel your account before the effective date.

12. General Provisions

• Entire agreement: these Terms constitute the entire agreement between you and ProTerapia;
• Waiver: failure to enforce any provision does not constitute a waiver of the right to enforce it in the future;
• Assignment: you may not assign your rights or obligations under these Terms without our consent;
• Severability: if any provision is found invalid, the remaining provisions continue in effect.
